Terms and Conditions

This website, www.lashoras.mx is owned by the company Índigo iniciativas S de R.L. de C.V., (hereinafter referred to as las horas) , with RFC IIN150303CYA and address at Carrer de la Caravel.la Niña, 12 5ª Planta 08017 Barcelona. This document is used for the company to Índigo Iniciativas S de RL de CV, constituted by public deed before the Notary Carlos Alejandro Durán Loera, of the notary nº 91 of the CDMX, on March 3, 2015, report the General Conditions governing the products and services offered through the website ofthe hours.

Concepts

PROVIDER: the service provider is Las Horas; it offers traditional artisan products from Mexico.

CUSTOMER: anyone who contracts the products of Las Horas. In the Conditions of Use and Services section of Las Horas, the concepts of both CLIENT and INTERESTED PARTY are used interchangeably depending on the context.

SERVICES: any product or service that Las Horas might offer; this will be its given concept name.

Applicable Laws and Conditions

Notwithstanding the provisions of these Conditions, Las Horas may request the CLIENT to accept additional and complementary clauses and conditions for accessing the SERVICES that the CLIENT wishes to access while browsing the different websites.

Las Horas will keep the CLIENT informed about the SERVICES that we can offer at all times, either through the Las Horas website or by any means provided by the CLIENT.

These conditions are affected by everything provided for in the General Data Protection Regulation (RGPD) (EU Regulation 2016/679), under Law 34/2002 of July 11, on Information Society Services and  Electronic Commerce, General Law 26/1984, of July 19, on the Defence of Consumers and Users; Law 7/1988, of April 13, on General Contracting Conditions, Law 7/1996, of 15 of January on the Arrangement of Retail Businesses, and under the Royal Decree 1906/1999, of December 17 of 1999, by which the Contracting of Telephonic or Electronic services with general conditions is regulated”.

Las horas reserves the right to request the CLIENT to accept additional conditions or clauses in order to access some SERVICES that the CLIENT might wish while browsing the website, without this affecting the current conditions.

Purpose of these Conditions

The purpose of these Conditions, as well as those on the Additional Conditions section that, if applicable, may be agreed on, is to regulate the use and access of the Las Horas website or webpages that are part of the aforementioned website, including the contents and services made available in them. Any person who accesses the portal www.lashoras.mx (hereinafter, also referred to as CLIENT) agrees to submit to the current General Conditions of the aforementioned web portal at all times.

Las Horas, the Las horas logo, and the other trademarks, logos, texts, graphics, distinctive signs and symbols of Las Horas and of all their service and product providers are trademarks of Las Horas or their respective owners. Under no circumstance will access to the portal by the CLIENT ever grant them any license or right to use the aforementioned brands, not even for its reproduction nor its personal or private use. 

The CLIENT understands that the services, graphics, texts, images, logos, source code, and user interface used to provide said services are the exclusive property of Las Horas as they are part of their intellectual property and are protected by the provisions of Royal Legislative Decree 1/1996, of April 12, which approves the revised text of the Intellectual Property Law, according to the wording given by Law 5/1998 of March 6, being the object of protection not only the data contained therein, but also in terms of data collection / systematization, in the terms provided in article 133 and following of the current Intellectual Property Law.

Any communications sent by the CLIENT will be incorporated into the Las Horas information systems. These communications will be used exclusively to tend to your request, and will be incorporated into our commercial and / or Newsletter database to send you information that may be of interest if the User authorizes it.

By indicating your personal data, and in accordance with the provisions of article 7 of EU Regulation No. 2016/679 and in Organic Law No. 3/2018, of December 5, Protection of Personal Data and guarantee of digital rights, you grant unequivocal consent to Las Horas, so it can proceed, in compliance with the purposes mentioned in the section above, to the processing of the personal data provided. Likewise, said consent extends to the transfer of data in accordance with applicable legislation. At any time, you can exercise your rights of access, rectification, opposition and, when required, cancellation, by communicating it in writing -and by indicating your personal data- to Las Horas, at the address indicated above, or through the following email address: info@lashoras.mx

Hyperlinks that allow a link to other pages or websites are used in this website. Las Horas will not be made accountable for the content or the security measures adopted by any other page or website through which this Website establishes access to, nor of those that allow a link to this Website; those sites will be accessed by the interested party under their sole responsibility.

The absence of viruses or other elements from the linked content from the Las Horas website that may cause alterations to the computer system (hardware and software), and in the documents or files of the CLIENT is also not guaranteed, excluding Las Horas of any responsibility derived from damages of any kind caused by all of the above.

Las Horas provides related content and / or content that may be of interest to the CLIENT. To do this, it can use different public sources. Whenever used content is visibly protected by copyright, the source will be always cited. In no case, will Las Horas be responsible for the accuracy, up-to-date information, opinions or theories included in said content if it hasn’t been personally produced.

Las Horas provides its SERVICES with a reasonable degree of professionalism. Las Horas cannot make any other promises or make any other warranties about its SERVICES and, in particular, does not warrant:

- Permanent availability of the products and / or services offered on this site; although it will make its best efforts to guarantee their regularity and proper functioning.

- The product offered by Las Horas is handcrafted, so it cannot be guaranteed that the product shown in the images will be exactly like the one that the customer will receive. There may be small variations due to the product’s characteristics.

- The quality of the product is tested in terms of shrinkage, colour fastness, resistance to seams, abrasion, piling, etc. All parameters being within tolerance; so good results are guaranteed whenever it is given the use and conservation treatment specified on the composition label. 

- The client will be able to use the SERVICES without any interruption or problem. Las Horas reserves the right to stop its services for indefinite periods of time or cancel them at any time for maintenance or technical reasons. When the time comes, Las Horas will communicate any incidents to those who may be affected as long as it has proof of the interruption.

- During the service there will be no viruses, computer attacks or other breaches or security problems, which will be considered force majeure, and Las Horas does not accept any responsibility derived from these events.

What is set forth in these Conditions shall not exclude or limit the liability of Las Horas for fraud or gross negligence on its part. However, Las Horas will not be responsible for any losses or damages caused by negligence, error or delay on its part, its managers or employees when performing their tasks in order to offer services to CLIENTS.

The CLIENT will be responsible for any measure taken by Las Horas in the framework of the investigation of a possible breach of these Conditions, or as a consequence of the determination or conclusion, by Las Horas, that there has been a breach of these.

Las Horas informs about the possibility of using secure data authentication systems that allow verifying the real identity of the user to avoid possible unauthorized access or identity theft. Las Horas reserves the right to report fraudulent identity theft attempts to State security authorities and agencies when hiring its services. All false or fraudulent personal data provided by customers may be considered a crime (forgery of commercial documents).

If Las Horas makes any serious negligence and causes damages due to non-compliance, the compensation may not exceed the amounts paid by the CUSTOMER affected by the contracted service that would have caused such damages.

Las Horas reserves the right to refuse the provision of services or the delivery of PRODUCTS to the CUSTOMER for commercial reasons, regarding uses and policies of business interest, and therefore also forfeiting to charge the prices established at any time in exchange for them.

The CLIENT may not oppose payments to Las horas of those purchases made by the personnel under their charge or by any third party, who have had access to their keys, even if they have occurred outside of their guidelines, due to lack of control or to the due diligence of its custody, failures in the security measures of its systems or any other cause beyond Las Horas.

Las Horas reserves the right to modify these Conditions, terms, privacy policies, and any other contract with the CUSTOMER for the provision of Las Horas services, always and at any time, and to establish new conditions or terms to adapt them to the new legislative or jurisprudential scenarios, in relation to the use of the SERVICES by the CLIENT. Such modifications, additional conditions and terms must be correctly informed to the CLIENT and, if these are accepted, they will have an immediate effect and will become an integral part of this Contract. If the CLIENT does not accept such modifications, Las Horas will have the right to terminate this Contract.

We make every effort to ensure that the information contained in the website is truthful and without typographical errors. In the event that an involuntary error of this type occurs at any given time, it will be immediately corrected. If there is a typographical error in any of the prices shown that is substantial and that implies a price significantly lower than the usual price of the product and a customer has made a purchase decision based on this error, we will communicate it and the customer will have the right to rescind their purchase at no cost to them. Sending an automatic purchase confirmation does not validate the erroneous price conditions.

To resolve any legal dispute arising from the interpretation and / or compliance with these Conditions, the parties, waiving any other general or special jurisdiction that may correspond to them, submit to the Courts and Tribunals of Bergara (Spain), without prejudice to the jurisdiction that could correspond to the CLIENT to be considered as a consumer for the purposes of these General Conditions.
